These Terms of Service ("Terms") govern your access to and use of the SerpDetective website at https://www.serpdetective.com and the SerpDetective Chrome Extension (collectively, the "Service"). The Service is operated by LitBuild (doing business as "SerpDetective") ("LitBuild", "we", "us", or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not access or use the Service.
1. Definitions
- "You" means the individual or entity using the Service.
- "Account" means the user account you create to access the Service.
- "Content" means information, inputs, and materials you submit to the Service (for example, keyword lists, saved items, and settings).
- "Paid Features" means subscription-based features that require payment.
- "Paddle" means Paddle.com, our online reseller and Merchant of Record.
- "Output" means reports, metrics, scores, analyses, or other results generated by the Service based on your inputs and third-party data sources.
- "Beta Features" means features identified as beta, preview, early access, or similar.
- "Keyword Lookup" means a request that retrieves keyword metrics or related data for one keyword (or one keyword-country pair), whether performed individually or as part of a batch.
- "Token" means a unit of text processing used by the AI/LLM features. Token counts may be reported by the model provider or estimated.
- "Usage" means measured consumption of the Service, including Keyword Lookups and Tokens.
2. Scope of the Service
The Service provides SEO-related data and workflow tools, including outputs derived from third-party sources. The Service is intended to support research and decision-making; it does not provide legal, tax, financial, or professional advice.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. If you are using the Service on behalf of an entity, you represent that you have authority to bind that entity.
4. Accounts and Security
- Registration. You must provide accurate information when creating an Account and keep it up to date.
- Account access. You are responsible for maintaining the confidentiality of your authentication methods (for example, OAuth access via Google and session tokens) and for all activities under your Account.
- Unauthorized use. You must notify us promptly if you believe your Account has been compromised.
5. Subscriptions, Payments, and Billing (Paddle)

Merchant of Record. Our order process is conducted by Paddle. Paddle is the Merchant of Record for purchases, processes payments, and issues receipts/invoices. Paddle may handle payment-related customer service inquiries (including refunds and chargebacks) in accordance with Paddle policies.

Billing cycle and auto-renewal. Paid plans are billed in advance on a recurring basis (monthly or yearly, as selected). Subscriptions automatically renew unless you cancel before renewal.

Taxes and currency. Applicable taxes (for example, VAT/GST/sales tax) may be calculated and collected by Paddle. Pricing and currency may vary by region and will be shown at checkout.

Price changes. We may change plan pricing. Where required, we will provide notice, and changes will take effect at the start of your next billing cycle.

Cancellations. You can cancel renewal via the Billing section of the Service or via links provided by Paddle (for example, in invoice emails). Cancellation stops future renewals; access to Paid Features typically continues until the end of the current paid period.

Refunds. Refunds are governed by our Refund & Cancellation Policy and Paddle policies, and may be limited where permitted by law.

Usage-based limits. Plans may include usage limits (for example, a monthly number of Keyword Lookups and a monthly Token allowance for AI features). These limits may be displayed in-product.
6. Free Trials, Discounts, and Promotions
From time to time, we may offer free trials, discounted pricing, or promotional codes. Eligibility, duration, and conditions will be shown at signup or checkout. We may modify or end promotions at any time, subject to applicable law.
7. License and Acceptable Use

License. Subject to these Terms and your compliance with them, LitBuild grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal purposes.

Acceptable use. You may not, and may not permit others to:
- Use the Service in violation of applicable law.
- Access, scrape, or extract data using automated means except through methods explicitly permitted by LitBuild.
- Reverse engineer, decompile, or attempt to derive source code from the Service (including the Chrome Extension), except to the extent such restriction is prohibited by law.
- Resell, lease, sublicense, or provide the Service to third parties without a written commercial agreement with us.
- Interfere with or disrupt the Service, bypass rate limits, or attempt to circumvent usage controls.
- Use the Service to build or enhance a competing product by systematically extracting or reproducing outputs.

Security and integrity. You must not probe, scan, or test the vulnerability of the Service, bypass authentication, or attempt to access non-public areas.

Export controls and sanctions. You represent that you are not located in, under the control of, or a national or resident of any country or territory subject to comprehensive sanctions, and you are not listed on any sanctions or restricted party list, to the extent applicable.
8. Plan Limits, Metering, and Fair Use
Paid Features may include usage limits (for example, Keyword Lookups and Token allowances for AI features). Limits and plan details are described in the Service and may change over time. Attempting to circumvent limits (including by account sharing or multi-accounting) is prohibited.
Metering principles:
- Keyword Lookups are metered per keyword request (including in batches). In some cases, cached results may reduce repeated third-party calls, but we may still count a Keyword Lookup for usage-limit purposes.
- AI usage is metered by Tokens. Token counts may be provided by the AI vendor or estimated based on input/output size, and may be rounded up.
- We may enforce limits by throttling, rate limiting, restricting features, or requiring you to wait until a quota resets.
Usage information displayed in the Service is provided for convenience and may be delayed or approximate. Where applicable, vendor-reported usage (for example, AI token counts) and our internal logs may be used to confirm actual Usage.
We may throttle, restrict, or suspend access if we reasonably believe usage is abusive, fraudulent, or materially degrades Service performance for others.
9. Beta Features
Beta Features are provided on an "as is" basis, may be modified or discontinued at any time, and may be subject to additional limits. Outputs from Beta Features may be less accurate or reliable.
10. User Content
You retain ownership of your Content. You grant LitBuild a worldwide, non-exclusive license to host, process, transmit, and display your Content solely to provide, maintain, and improve the Service and to enforce these Terms.
You represent and warrant that you have the rights necessary to submit Content and that doing so does not violate applicable law or third-party rights.
11. Output and Data Accuracy
- Outputs are estimates. Outputs are based on your inputs and third-party data sources and may be incomplete, delayed, inaccurate, or change over time.
- No guarantee of results. We do not guarantee rankings, traffic, revenue, or business outcomes.
- Your responsibility. You are responsible for validating Outputs and deciding how to use them.
12. Third-Party Services and Data
The Service may incorporate or rely on third-party services and data sources (for example, DataForSEO, Google Search). We do not control third-party services and are not responsible for their availability, content, or changes.
SEO and keyword metrics are estimates and may fluctuate due to changes in third-party data sources and search engine behavior.
13. Feedback
If you provide feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without compensation, and you represent you have the right to do so.
14. Intellectual Property
The Service, including its software, design, and content (excluding your Content), is owned by LitBuild and is protected by intellectual property laws. We reserve all rights not expressly granted.
Our trademarks and trade dress may not be used without our prior written consent.
15. Service Availability; Changes
We may modify, suspend, or discontinue any part of the Service at any time, including features, limits, or supported integrations. We will use reasonable efforts to provide notice of material changes where practicable.
The Service may be unavailable from time to time due to maintenance, upgrades, outages, or events outside our control.
16. Suspension and Termination
We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, used the Service fraudulently, or posed a security risk. You may stop using the Service at any time.
If you request a refund or initiate a billing dispute, we may temporarily restrict access to high-cost features (for example, AI features) while the request is reviewed, to prevent further chargeable consumption.
Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination will survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law and Venue).
17. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITBUILD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
SEO DISCLAIMER: LITBUILD DOES NOT GUARANTEE THAT USING THE SERVICE WILL IMPROVE SEARCH RANKINGS, TRAFFIC, OR REVENUE. RESULTS DEPEND ON MANY FACTORS OUTSIDE OUR CONTROL.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITBUILD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITBUILD'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations. In such cases, these limitations apply to the maximum extent permitted by law.
19. Indemnification
You agree to defend, indemnify, and hold harmless LitBuild from and against claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or your violation of these Terms.
20. Governing Law and Venue
These Terms are governed by the laws of the People's Republic of China, without regard to conflict of laws principles.
To the extent permitted by law, disputes arising out of or relating to these Terms or the Service will be submitted to the competent courts located in Beijing, China.
Nothing in these Terms affects any mandatory consumer rights you may have under applicable law.
21. Notices
We may provide notices by posting them within the Service, on the Website, or by email to the address associated with your Account. You are responsible for keeping your email address current.
22. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
23. Severability; Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later.
24. Entire Agreement
These Terms, together with any policies referenced (including the Privacy Policy and Refund & Cancellation Policy), constitute the entire agreement between you and LitBuild regarding the Service.
25. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice as required. Continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.
